Disturbing New Evidence Released in Caylee Anthony Murder Case

February 19, 2009

Caylee Marie Anthony On Wednesday, the Florida State Attorney's Office released hundreds of pages of discovery documents in the Caylee Anthony murder case. The documents provide details about the discovery of the remains and also delve into previously unreleased details regarding the state's evidence.

Within the documents, Orange County Sheriff's Office Detective Yuri Melich details the observations that he made at the crime scene on Dec. 11, 2008.

"Once we arrived at the scene, we were directed to a location on Suburban Drive just east of Hopespring Drive on the south side of the road," Melich's report reads. "Just past the end of a wooden fence was a path leading south into the wood line. Within a short distance down this path, and to the west (right), was a black plastic bag and lying next to it what appeared to be a human skull. The skull was void of flesh but quite a bit of hair could be seen on and around it. The skull appeared to be that of a child or young adult. I immediately noticed that there appeared to be a piece of silver duct tape across the mouth area of the skull. The tape appeared to have been purposely placed there."

Melich reports that there were two bags next to the skull – one a black plastic bag and the other a tan colored canvass bag. A white and pink striped article of clothing was also found next to the bags.

Gatorade bottle An additional item of interest found at the scene was a Gatorade bottle that contained unknown liquid and white sediment. A syringe wrapped in a toilet paper roll was found inside the bottle.

Once the items were logged and photographed, they were transported to the medical examiner's office for further investigation.

Melich's report further details the items that were found inside the bags by Dr. Gary Utz, the lead pathologist assigned to the case. Those items were describes as a Winnie the Pooh blanket, a pair of Circo brand size 24-months pink and white striped shorts, the collar of a t-shirt, and parts of what appears to be a pair of pull-up pants for a child.

In regards to the skull and the duct tape found on it, Melich wrote about observations he made while at the medical examiner office:

Sticker "The duct tape over the mouth area of the skull appears to have caught up the hair alongside the skull. This is what appears to have kept the tape in place. The hair had to be cut in order for the tape to be properly removed…. On the tape within a black oval was written the word 'HENKEL.' Also written on the tape was 'Consumer Adhesives Inc. max temp 200f Avon Ohio 44011.' The tape was affixed to the skull in such a manner that the mandible was still adjacent to the skull."

The documents also provided information regarding the revelation last month of a "heart shaped" sticker that had been placed on duct tape that was found wrapped around the child's skull.

As a result of the discovery and the evidence recovered at the scene, authorities obtained a search warrant for the Anthony family home. During that search, several items of interest were found and taken into evidence. Among the items seized was a cloth laundry bag; a red gas can that had a piece of "HENKEL" duct tape adhered to it that "appeared to be the same make and brand as the tape found on the body;" a photograph of Caylee wearing "pink and white vertical striped" shorts; black plastic bags; and several articles of "Circo" brand clothing.

One particular item of interest found during the search was a diary that had allegedly been written by Casey Anthony.

Diary

It remains unclear in what year the diary was written; however, an entry dated June 21 contains statements that could prove to be vital to the prosecution's case. That entry reads:

"I have no regrets, just a bit worried. I just want everything to work out okay. I completely trust my own judgment and know that I made the right decision. I just hope that the end justifies the means. I just want to know what the future will hold for me. I guess I will soon see.

"This is the happiest that I have been in a very long time. I hope that my happiness will continue to grow.

"I've made new friends that I really like. I've surrounded myself with good people.

"I am finally happy, let's just hope that it doesn't change."

Casey Marie Anthony In addition to providing information about the searches, the documents give details about the interviews with Casey Anthony's friends. One of her friends described Anthony's mother, Cindy Anthony, as "overbearing" and someone who tried to "run the show." The documents say Casey Anthony considered herself to be a bad mother and that she once considered committing herself to a mental institution. Her friends also reiterate that they never met Caylee's alleged babysitter, Zenaida Gonzalez.

"After several months of investigation, detectives could find no one who has ever met, spoken with or seen any Zenaida Gonzalez who had cared for Caylee Anthony," Melich wrote. "There has been no factual evidence to suggest that anyone besides Casey Anthony was the last one to be with Caylee when she was last seen alive. Almost everyone who knows Casey Anthony admits she was prone to lying. Based on statements and eye witness accounts, it appears that Caylee was last seen alive on June 16, 2008. Evidence obtained from the white 1998 Pontiac Sunfire, along with evidence found with the body, suggests that Caylee died between June 16 and June 27, 2008. Evidence also suggests that the body of Caylee Anthony was in the trunk of the white 1998 Pontiac for a period of time but removed prior to June 27, 2008. Evidence on the body suggests that the child's death was not accidental but an intentional act. As of this writing, there is nothing to suggest that anyone but Casey Anthony is responsible for the death and disposal of Caylee Anthony."

Anthony Family Garage Hundreds of pages of supplemental reports and photos are also among the documents. One particular report, authored by the FBI crime lab, addresses the duct tape that was found on Caylee's skull and the gas can that was seized from the Anthony family residence.

"Based on examinations, the pieces of duct tape found on the body and on the gas can are comparable to one another in all physical attributes and in the chemical composition of their backing and adhesive components," the FBI crime lab report reads. "Therefore, they originated from the same source roll of tape or from rolls of tape manufactured in the same manner."

The documents do not mention any fingerprints found on the duct tape.

In the hours following the release of the discovery documents, Marti Mackenzie, a spokesperson for Casey Anthony's attorney, Jose Baez, issued a statement regarding the release of the documents. In it, she wrote:

Jose Baez "According to defense lawyers for Casey Anthony, the State's forensic report on duct tape, plastic bags and other items is a one-sided law enforcement-generated report and is biased and speculative."

Mackenzie also stated. "It uses 'junk science,' the kind of flawed comparative analysis that the two-year study by National Academy of Sciences released today."

Mackenzie also included comments from defense co-counsel Linda Kenney Baden.

"Not only is this brand of tape the most widely sold in the United States, the State is relying on comparative analysis just like comparisons exposed as flawed in the study of bullet lead in 2004. These chemical studies have put hundreds of innocent people in jail," Baden said.

In the end, it will be up to a jury to determine whether the state has enough evidence to prove its case. The trial is expected to begin in the fall of 2009.

Casey Anthony, who faces charges of first-degree murder, remains behind bars at the Orange County Jail.
